ST. CROIX — United States Attorney Delia L. Smith announced this week that Edelfonso Garcia, 45, of St. Croix appeared before Magistrate Judge Emile A. Henderson, III on for his initial appearance hearing after being arrested on a 2004 firearms possession warrant from the Florida. Garcia waived his detention and preliminary hearing and agreed to be returned to Florida to face charges.
Garcia was convicted in 2001 in Florida for firearm possession in a school zone, and sentenced to five years on probation in lieu of jail time. However, in 2004 Garcia was slapped with a string of criminal charges — attempted first-degree murder, aggravated battery with a deadly weapon, burglary and criminal mischief. The charges were a violation of his probation terms, and thus a warrant was issued by Florida's courts.
It is unclear when Garcia returned to his native St. Croix, but last Friday, January 13th, Garcia was arrested by the V.I. Department during an early morning operation at a residence in Pepper Tree Terrace.
Executing search warrants in connection with an investigation into the homicide of Bradley Maxwell on December 28th 2022, officers found ammunition and drugs in the residence. Garcia, age 45, was arrested and charged locally with possession of ammunition and possession of a controlled substance with intent to distribute.
He appeared in the Superior Court on Monday for advisement hearing. Now, with criminal charges pending against Garcia in both Florida and the USVI, it is unclear in which order the matters will be adjudicated.
