Woman Illegally Parked Uses Metal Bat to Destroy Driver's Side Window of Tow Truck, Assault Driver, Police Report Says

ST. THOMAS — A woman has been arrested and charged with assault over a parking space in St. Thomas.

Kernisha Naomi Daniel was recently arrested on charges of third-degree assault, simple assault, destruction of property, damaging and tampering with a vehicle and disturbance of the peace.

The arrest follows a report by a man who was contracted to tow vehicles illegally parked in the Magens Bay Junction Apartments area.

According to the documents before the courts, on Thursday the man made an inspection of the area and observed a black Honda in a no parking area, blocking the handicap ramp in Building One. He left the area and traveled to Building Two to tow a white van and when he returned to Building One, the black Honda was still there. He stated that he then proceeded to hook the vehicle up on the wreck to tow it. That's when Daniel came out of the elevator, using explicit language, asking him where he was going with her car. He then advised Daniel that the no parking sign was posted along the wall, and she told him that she came to the manager. He then told her to call the manager to which she did. The manager advised her that the man was contracted to tow for the property. He then stated that he would give Daniel a break and asked her not to park there again. However, Daniel continued to verbally abuse the complainant, at which point he told her that she should forget about the break, and that she or the manager had to pay for his service.

While he was dropping the lever of the two truck to take the vehicle off the wrecker, Daniel grabbed the control lever and yanked it, causing it to break.

According to court documents, the man then pushed her, and Daniel then punched him in the head. Daniel proceeded to run to the back of her vehicle and retrieved a metal bat. She came back to him swinging the bat, at which point he stepped back to avoid being hit. The complainant stated that he then walked away from her, however Daniel then walked up to the tow truck and swung the bat at the driver side window, causing the glass to break. The complainant stated that she then walked back towards him and said, "you're next," while swinging the bat at him, hitting his hand. He was able to grab the bat from her hand and walked towards the elevator. She walked back towards him and grabbed the bat, but a male citizen saw the commotion, intervened and held the bat. The complainant then called 911.

In court on Friday, a judge ruled that Daniel is not to leave the St. Thomas/St John District without the court’s permission if she is able to make bail. She is to report to the office of probation once a week. Daniel is also forbidden from having contact, directly or indirectly with the alleged victim and is to stay at least 50 ft away from him. She is not to possess a firearm or ammunition while the matter is pending.

Daniel was allowed to post 10 percent of the $6,000 bail amount. Her arraignment is on September 30th.
