Man Who Allegedly Assaulted Girlfriend With Gun During Dispute Arrested

ST. CROIX — A judge has ordered a curfew for a man found in possession of an illegal firearm after he reportedly assaulted the mother of his child. Jamie Flemming has been charged with third-degree assault, simple assault and battery, unauthorized possession of a firearm and possession of a controlled substance with intent to distribute.

According to the probable cause fact sheet submitted to the court, the alleged victim was getting ready to leave home on Saturday morning when she and Flemming began to argue. She said that he got upset over a miscommunication and proceeded to take their infant son into his arms while he began to pack items. The woman says she held onto Flemming’s arm and asked him to return the child to her, but instead he used his left hand to push her head against a wall. 

She told police that he then opened a drawer and retrieved a black firearm which she did not know was in her home. The victim says she held Flemming’s hand and removed the gun from his possession while continuing to ask for the child. He then allegedly took the gun from her and used it to hit her in the back of the head while yelling “you are gonna make me do something crazy.” The accused then left the residence. 

When police arrived, the woman showed them injuries to her left temple as well as the back of her head and complained of pain to the left side of her face. Officers subsequently put out an All Points Bulletin (APB) for Flemming and he was located later that afternoon at a bar. During his arrest, officers discovered a black Taurus 9mm firearm in the glove compartment of his vehicle and a subsequent check revealed that he did not possess a firearm license. According to the fact sheet, Fleming was also found in possession of a brown paper bag containing multiple vials, baggies and sandwich bags of what later tested positive for marijuana, weighing in at 225.7 grams.  

At Flemming’s advisement hearing on Monday, Assistant V.I. Attorney General Jasmine Griffin objected to Attorney Kathryn Slade’s request for the defendant to be released on the posting of $1000. Slade had recommended that Flemming be permitted to sign an unsecured bond for the remainder of the bail amount which was set at $50,000. However, Griffin stressed that the defendant was apprehended with an unlicensed firearm and a controlled substance, arguing that the $50,000 bail reflects the seriousness of the charges against him. As such, Griffin asserted the people’s request that Flemming post no less than 25 % of the bail figure. 

Judge Darryl Donohue set the bail conditions after considering the arguments from both sides, as well as Slade’s revelation that Flemming could only afford to post $2000. Donohue granted the defendant bail in the amount of $2000 cash and an unsecured bond for the remainder of the $50,000 sum. While the matter remains pending, Flemming will reside with a court-approved third-party custodian and has been prohibited from having any contact with the alleged victim. The defendant will also be subjected to a 6:30 p.m. to 6:00 a.m. curfew on weekdays and a 5:00 p.m. to 6:00 a.m. curfew on weekends.
