ST. CROIX — Jimmy Davis, 41, of St. Croix, had his supervised release revoked and was sentenced to 24 months incarceration United States Attorney Gretchen C.F. Shappert announced Friday. Davis was originally sentenced to federal prison for 33 months in 2010 and has been on supervised release since 2014.
Chief Judge Wilma A. Lewis conducted a revocation hearing on November 25, 2019. At the conclusion of the hearing Judge Lewis found that on December 12, 2017, Davis assaulted his live-in girlfriend and choked her, and that these acts constituted the offenses of second-degree assault and simple assault and battery. Additionally, Judge Lewis found that Davis was convicted by jury trial on April 12, 2019, of simple possession of cocaine and aggravated assault and battery.
According to the jury trial testimony, on February 26, 2018, Virgin Island Police Department officers arrested Davis on an outstanding Superior Court warrant. At the time of his arrest, Davis was in possession of 9.61 grams of crack cocaine. This cocaine was located in his front right pants pocket. The DEA Southeast Laboratory in Miami, Florida, subsequently analyzed the crack cocaine and confirmed it to be cocaine base, a Schedule II controlled substance.
Additionally, while the defendant was being processed and booked at the police station after his arrest, he became boisterous, verbally threatening, and then intentionally kicked Officer Travis Herbert in the right thigh area.
Davis is facing additional sentencing on February 28, 2020, on his Simple Possession of Cocaine and Aggravated Assault and Battery convictions.
The cases were investigated by the Virgin Islands Police Department and the Drug Enforcement Administration. Assistant U.S. Attorneys Daniel H. Huston and Alphonso G. Andrews prosecuted the cases.
