ST. CROIX — A man has been charged with assault and battery after he allegedly brutalized his girlfriend.
Sham Malaykhan was arrested on Sunday afternoon following reports of an assault. According to the probable cause fact sheet, the alleged victim told police that she had recently returned to St. Croix and discovered that her boyfriend had been texting other women. She then confronted Malaykhan about the texts and he got upset, telling her to leave his home. The woman then called a friend while packing to leave and Malaykhan reportedly got even more upset, stating “How could you leave so quick, that mean you going by another man.” She said that he then threw her stuff on the floor, pushed her and she pushed him back. Based on the victim’s statement to police, Malaykhan allegedly put her in a headlock and applied pressure to her neck, but she could still breathe.
When police contacted Malaykhan about the alleged incident, he stated, “That [expletive]. But she’s leaving my house now, so I don’t care.” According to the probable cause fact sheet he then stated that he pushed her because he wanted her out of his home and then he grabbed her by her shirt. However, he was unable to state what he did to the woman after he grabbed her by the shirt.
Police also contacted an individual who witnessed the assault. The witness told police that Malaykhan had the woman up against the gate and the witness also saw him strike her with his fists and slam her belongings on the floor. The witness said that Malaykhan assaults the woman all the time. The witness, who expressed frustration with the constant assault of the victim, further told police that something must be done before the woman gets badly hurt by Malaykhan. A second witness also stated that they saw Malaykahn hold the woman by the neck and strike her.
Malaykhan was transported to the Bureau of Corrections after being arrested and charged.
At his advisement hearing on Monday, attorney Leslie Davis requested that bail be set at $1000 and asked for Malaykhan’s release on the posting of $101 and the signing of an unsecured $899 bond. The judge agreed to the recommended bail conditions, stating that Malaykhan must have no direct or indirect contact with the alleged victim or any witnesses while the matter is pending.
