ST. THOMAS — A man has been ordered to vacate his marital home after he allegedly assaulted his wife in the presence of their minor son.

Lucius Dorcely is charged with disturbance of the peace and simple assault. According to the probable cause fact sheet accompanying his arrest, Dorcely began cursing at his wife after she returned home on the evening of January 22nd. The woman told police that her husband initiates verbal altercations daily. On the evening in question, she went outside and briefly spoke to a neighbor after her husband began cursing loudly. However, when she returned to the residence, Dorcely allegedly grabbed her, slapped her to the face and pushed her into a wall. The woman fell to the ground and her minor son called for police assistance after witnessing the physical assault, according to the probable cause fact sheet.

The responding officers noted that they observed injuries to the woman’s leg and face. However, she reportedly refused medical attention. The officers made contact with Dorcely inside the residence and he claimed that he had never had a physical altercation with his wife. He was subsequently placed under arrest and detained at the Bureau of Corrections where he remained until his hearing on Monday morning.

At that hearing, Assistant V.I. Attorney General Brenda Scales asked that bail be set at $1000 and that Dorcely remove himself from the residence. At the conclusion of the hearing, Judge Paula Norkaitis granted Dorcely’s release on the posting of 10 percent of his bail set at $5,000.

Apart from one opportunity to retrieve his belongings under police escort, Dorcely is prohibited from returning to the home he shares with his wife. However, the judge emphasized that he is ordered to continue making any rent or other payments necessary to ensure his wife’s continued residence at the property. Additionally, while the matter is pending, the defendant must remain at least 40 feet away from the alleged victim and is strictly prohibited from having any unlawful contact with her.
