A St. Thomas man is suing Home Depot for injuries caused by him reportedly tripping and falling on the corner of a pallet left in the middle of the floor.

A civil complaint filed by Kenneth Howard alleges that he was at the Home Depot in August 2023. After selecting his items, he was on his way to the cashier when he says his foot got caught “on the end of a wooden pallet that was left in the middle of the flor without a pallet guard.”

His trip led to a fall, and Mr. Howard said that “his head struck the edge of the counter.” He then fell to his knees, bleeding from the head with a laceration to the area around his left eyelid. Employees gave him a bandage, and a store manager reportedly provided some medical assistance.

Mr. Howard went to the Schneider Regional Medical Center immediately after leaving the Home Depot, complaining about pain to his left knee and left eye. Doctors reportedly diagnosed him with trauma to the eye and a sprained knee.

According to the lawsuit, Mr. Howard was bedridden and incapacitated due to the pain he suffers, and he continues to suffer lingering pain two years onward which makes him walk with a limp.

He blames the negligence of Home Depot for his fall and subsequent injury, and is seeking an award from the courts to compensate him for the damages caused by the incident.

The HDVI Holding Company had not yet filed their response to the complaint as of press time.
